Terms of Use — True Path

1. Acceptance of the Terms

These Terms of Use (“Terms”) govern access to and use of the True Path mobile app (available for Android and iOS) and the website www.truepath.com.br (collectively, the “Platform”), operated by Associação True Path, a private legal entity incorporated as a nonprofit association (Civil Code, Art. 53), registered with the CNPJ under No. 62.136.935/0001-57, with headquarters at Rua Horácio Bandieri, 209, São Paulo-SP, ZIP Code 05653-030 (“True Path,” “we,” or “Association”).

By creating an account, checking the acceptance boxes during onboarding, or using any feature of the Platform, you (“User” or “you”) represent that you have read, understood, and fully agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform.

2. Definitions

For the purposes of these Terms:

  • True Path Content: all material developed, organized, curated, or produced by the Association, including personalized Bible reading plans, devotionals, reflections, texts, audio files, videos, icons, branding, visual identity, personalization methodology, prompts, conversational flows, knowledge base, and app architecture.
  • User Content: notes, messages sent in chat, responses during onboarding, prayer logs, bookmarks, and any data voluntarily entered by the User on the Platform.
  • Bible AI Chat: Natural language interaction feature using artificial intelligence models integrated into the Platform.
  • LGPD: Law No. 13,709/2018 — General Personal Data Protection Law.

3. Eligibility and Registration

3.1. Minimum Age

The Platform is intended exclusively for individuals 18 (eighteen) years of age or older. By registering, the User declares, under penalty of law, that he or she is of legal age and fully capable of entering into civil transactions (Civil Code, Art. 5).

The Association does not allow individuals under the age of 18 to register, even with the consent of a legal guardian. This restriction stems from the fact that the Platform:

  • Collects sensitive personal data (LGPD, Art. 11), including information about feelings, personal challenges, and religious beliefs;
  • It offers an AI-powered Bible chat that can address sensitive topics;
  • It offers reflections and content designed for an adult audience that possesses full capacity for discernment and takes responsibility for its own spiritual decisions.

The Association may, at any time, request proof of age and suspend or terminate accounts if there is reasonable suspicion that they are being used by a person under the age of 18. If an irregular registration is identified, the account will be closed and the personal data deleted, in accordance with the policy described in the Privacy Policy.

3.2. Registration

To access all features, the User must provide accurate, complete, and up-to-date information. It is the User’s responsibility to:

  • Maintain the confidentiality of access credentials;
  • Immediately report any unauthorized use of the account;
  • Do not share your account with third parties.

3.3. Single Account

Each user may maintain only one active account. Duplicate, fake, or fraudulent accounts may be deleted without prior notice.

4. Service Description

True Path offers a personalized Bible reading app based on an evangelical/Protestant theological perspective, which includes:

  • Onboarding with questions about reading habits, life stage, feelings, and spiritual challenges;
  • Generation of personalized reading plans based on user responses and generative artificial intelligence;
  • Bible AI Chat for conversations, questions, and reflections, supporting text-based interaction and, optionally, voice interaction (the user’s audio recording is transcribed into text before being processed by the AI);
  • Personal note-taking and spiritual journaling features;
  • Optional profile photo, which the User can add from the device's gallery or camera;
  • Audio content produced by True Path (narrated devotionals, Bible readings, audio reflections) for playback within the app;
  • Written devotional content, reflections, and supplementary materials.

4.1. Device Permissions

The use of certain features requires specific permissions (microphone, camera, photo gallery), which are always requested at the time of use and may be granted or denied at the User’s discretion, without affecting access to other features. See the Privacy Policy for details.

True Path is not a religious institution, church, pastoral ministry, or psychological, medical, or legal counseling service. See Section 11 (Exemptions).

5. License Agreement

True Path grants the User a personal, limited, revocable, non-transferable, non-exclusive, and non-sublicensable license to access and use the Platform and True Path Content, solely for personal, non-commercial purposes and for individual spiritual growth.

5.1. What you CAN do

  • Access the Platform on your personal devices;
  • Save content for personal offline use (when available);
  • You may share excerpts from True Path content with friends, family, or your religious community, provided that: it is for strictly personal, non-commercial purposes; you include attribution to the True Path brand whenever reasonably possible (e.g., “via @truepath” or “True Path”); you do not remove watermarks, credits, or identifiers; and you do not substantially modify the content.

5.2. What You CANNOT Do

The following is expressly prohibited, under penalty of immediate termination of the account, damages, and applicable legal action:

  1. Using True Path Content for commercial purposes or direct or indirect monetization, including, but not limited to: resale, advertising, paid courses, books, e-books, sponsored podcasts, monetized sermons, and for-profit social media content without prior written authorization;
  2. Systematically copy, reproduce, mass-distribute, or publish True Path Content on other platforms, websites, apps, or social media;
  3. Create derivative products, applications, or services (“copycats”) that imitate, replicate, or are substantially inspired by True Path’s Platform, methodology, onboarding flows, conversational architecture, prompts, or customized plans;
  4. Reverse engineer, decompile, disassemble, or attempt to extract the source code, prompts, AI instructions, customization logic, database, or technical structure of the Platform;
  5. Engaging in scraping, crawling, automated scraping, or bulk content extraction, including through bots, scripts, headless browsers, or unauthorized APIs;
  6. Use True Path Content, in whole or in part, to train, fine-tune, or develop artificial intelligence models, machine learning systems, or AI-derived products, unless expressly authorized in writing;
  7. Reproducing True Path's name, brand, logo, visual identity, or distinctive marks on any product, service, or material without written authorization;
  8. Circumventing the Platform’s technical protection measures, authentication systems, usage limits, or monitoring tools;
  9. Accessing the Platform through unauthorized automated means, including bots, third-party AI agents, or unofficial integrations;
  10. Posting illegal content, hate speech, content that incites violence, pornography, content that infringes on the rights of third parties, or content that violates Brazilian law in the input features (chat, notes, etc.).

5.3. Reservation of Rights

Any right not expressly granted in these Terms remains fully reserved by True Path.

6. Intellectual Property

6.1. True Path Content

All intellectual property rights in the True Path Content, the Platform, the “True Path” brand and name, the logos, design, source code, database, onboarding flows, AI prompts, personalization methodology, and related materials are the exclusive property of the Association or its licensors, protected by the Copyright Law (Law No. 9,610/98), the Industrial Property Law (Law No. 9,279/96), and other applicable regulations.

6.2. Registered Trademark

“True Path” is a registered trademark (or trademark pending registration) of the Association with the INPI. Any unauthorized use of the trademark constitutes trademark infringement.

6.3. Biblical Content

The Platform uses biblical texts from translations in the public domain or licensed by their respective rights holders. The rights to these biblical translations and versions remain with their respective rights holders.

6.4. User Content

You retain all rights to User Content (notes, messages, personal records). By submitting User Content to the Platform, you grant True Path a worldwide, royalty-free, non-exclusive, sublicensable (only to subprocessors) license, for the term necessary to provide the service, to:

  • Store, process, and display your content back to you;
  • Use it to generate personalized plans, suggestions, and AI-powered responses tailored exclusively for you;
  • Process the data in an aggregated and anonymized manner (without identifying you individually) to improve the Platform.

True Path will NOT use User Content to:

  • Train general-purpose AI models;
  • Sell or share with third parties for commercial purposes;
  • To display publicly without your express permission.

You may revoke this license at any time by requesting the deletion of your account and data (see Privacy Policy).

7. Artificial Intelligence and the Bible Chatbot

7.1. The Nature of AI

The AI Bible Chat is an automated tool that uses large-scale language models (LLMs) provided by third parties (OpenAI, Anthropic, Google, and AWS). Responses are generated algorithmically and may:

  • Contain errors, inaccuracies, or “hallucinations” (made-up information);
  • Does not reflect the official position of any specific Christian denomination;
  • Vary the interactions, even when asking similar questions;
  • This is not a substitute for in-depth Bible study, pastoral guidance, professional counseling, or consulting the Scriptures.

7.2. Verification

You acknowledge that you should critically evaluate the AI’s responses by comparing them with Scripture, reliable reference books, and, when applicable, with spiritual leaders in your community.

7.3. Limitations

True Path's AI does NOT provide, and you agree not to use it for:

  • Medical, psychological, or psychiatric counseling;
  • Legal, tax, or financial advice;
  • Diagnostics of any kind;
  • Critical decisions about health, relationships, or life crises.

7.4. Crisis Situations

If you are experiencing an emotional crisis, suicidal thoughts, self-harm, or an imminent risk, seek help immediately:

  • CVV — Center for the Value of Life: 188 (toll-free, 24 hours a day)
  • Emergency Medical Services (SAMU): 192
  • Nearest CAPS (Psychosocial Care Center)
  • Emergency Room or Medical Emergency

True Path is not an emergency service, and the AI is not equipped to handle crisis situations.

8. Religious Content

8.1. Theological Perspective

True Path presents content from an evangelical/Protestant Christian theological perspective. We are not an ecclesiastical authority, denomination, or official ministry. This content is not a substitute for pastoral teaching, the sacraments, ecclesial fellowship, or participation in a local faith community.

8.2. Interpretive Pluralism

You acknowledge that biblical interpretation allows for legitimate diversity within Christianity. The content of True Path reflects one of several possible perspectives and does not claim to be the sole valid interpretation.

8.3. Respect and Non-Discrimination

We respect the freedom of religion guaranteed by the Federal Constitution (Art. 5, VI). The Platform does not discriminate on the basis of belief, religious denomination, race, gender, sexual orientation, nationality, or any other characteristic.

9. Nonprofit Status and Associative Nature

9.1. Free app

The Platform is currently offered free of charge to its users. There are no fees, monthly charges, subscription fees, or other financial charges for accessing and using the available features.

9.2. Associative Nature

True Path is operated by the True Path Association, a private legal entity established as a nonprofit association (Civil Code, Articles 53–61). Any donations, institutional partnerships, and funds raised are used exclusively for the maintenance and advancement of the Association’s objectives, with no distribution of profits.

9.3. Future Paid Features

True Path reserves the right to introduce paid features, premium plans, or contribution options (such as “donate-to-unlock” and subscriptions) in the future, provided that:

  • A minimum of 30 (thirty) days' advance notice to users;
  • Maintaining a core set of essential features free of charge whenever feasible;
  • The User’s specific and express acceptance of the new terms and conditions, prior to any billing;
  • Compliance with the Consumer Protection Code and other regulations applicable to consumer relations, including the right of withdrawal (Art. 49, CDC).

9.4. Donations

True Path may accept voluntary donations from individuals or legal entities who wish to support its operations. Donations are voluntary, irrevocable (except in cases of obvious error), and do not entitle the donor to any specific consideration, commercial advantage, or special rights, in keeping with the organization’s non-profit nature.

10. User Conduct and Suspension

10.1. Acceptable Use

You agree not to:

  • Using the Platform for illegal purposes;
  • Harass, threaten, or harm others;
  • Posting content that is defamatory, obscene, violent, or that infringes on rights;
  • Interfere with the operation of the Platform;
  • Attempting to access restricted areas or other users' accounts.

10.2. Suspension and Termination

True Path may suspend or terminate your account, with or without prior notice, in the event of:

  • Violation of these Terms;
  • Fraudulent or abusive use;
  • Legal or judicial order;
  • A threat to the security of the Platform or other users.

In the event of closure, your data will be handled in accordance with the Privacy Policy.

11. Disclaimers

11.1. “As is”

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including, without limitation, warranties of fitness for a particular purpose or freedom from errors.

11.2. Limitations

True Path is NOT responsible for:

  • Spiritual, personal, financial, medical, or any other decisions made based on the Platform’s content or AI responses;
  • Inaccuracies, errors, or “hallucinations” generated by AI;
  • Temporary unavailability of the Platform due to maintenance, technical failures, cyberattacks, or unforeseeable circumstances/force majeure;
  • Conduct of third parties, including LLM providers, app stores, and payment providers;
  • Loss of User Content in the Event of Account Deletion Requested by the User.

11.3. Limitation of Liability

To the fullest extent permitted by law, True Path’s total liability for any claim related to the Platform is limited to the amount actually paid by the User in the last 12 (twelve) months or R$ 500.00 (five hundred reais), whichever is greater. This limitation does not apply in cases where such a limitation is prohibited by the CDC.

11.4. Unforeseeable Circumstances and Force Majeure

True Path is not liable for failures resulting from unforeseeable circumstances, force majeure, cyberattacks, third-party failures (cloud providers, LLMs, app stores), internet outages, or government mandates.

12. Compensation

You agree to indemnify and hold harmless True Path, its partners, officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms;
  • Misuse of the Platform;
  • Infringement of third-party rights, including intellectual property rights;
  • User Content posted on the Platform.

13. Changes to the Terms

True Path may modify these Terms at any time. Substantial changes will be notified at least 15 (fifteen) days in advance via:

  • Registered email address;
  • In-app push notification;
  • Notice displayed on the Platform.

Continued use after the notification period constitutes acceptance of the new versions. If you do not agree, you must close your account.

14. General Provisions

14.1. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil, specifically the LGPD (Law No. 13,709/2018), the Brazilian Civil Rights Framework for the Internet (Law No. 12,965/2014), and the Consumer Protection Code (Law No. 8,078/1990).

14.2. Jurisdiction

The courts of the District of São Paulo, SP, are hereby designated as the exclusive forum for resolving any dispute, to the exclusion of any other forum, however preferential it may be, without prejudice to the consumer’s right to file a lawsuit in the courts of his or her domicile (Art. 101, I, CDC).

14.3. Amicable Resolution

Before taking legal action, the parties agree to seek an amicable resolution through direct contact via suporte@truepath.com.br, with a 30-day deadline for a response.

14.4. Severability of Provisions

If any provision is found to be invalid or unenforceable, the remaining provisions shall remain valid and in full force and effect.

14.5. No Waiver

The failure of any party to require compliance with any provision shall not constitute a waiver or novation.

14.6. Assignment

You may not assign these Terms to any third party. True Path may assign its rights and obligations to successors, parent companies, subsidiaries, or as a result of a merger, acquisition, or corporate reorganization, upon prior notice.

14.7. Entire Agreement

These Terms, together with the Privacy Policy and other referenced documents, constitute the entire agreement between you and True Path regarding the Platform.

14.8. Language

The Brazilian Portuguese version of these Terms takes precedence over any translation.
